These Terms of Use ("Terms") govern your access to and use of Kuro Ai (the "Service"), operated from kuro-ai-baby.com. By accessing, browsing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing or otherwise using Kuro Ai, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity.
2. Eligibility and Age
The Service is intended for adults aged 18 years or older. By using Kuro Ai you represent and warrant that you are at least 18 years old and that your use of the Service does not violate any applicable law in your jurisdiction.
3. Nature of the Service
Kuro Ai provides interactive AI-driven characters ("Companions"). Companions are entirely fictional and generated by software. They are not real people, do not possess consciousness, and any opinions, statements or advice produced by them must not be relied upon as professional guidance.
4. Account Registration
You may need to register an account to use certain features. You agree to provide accurate, current and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account.
5. Account Security
Notify us immediately at hello@kuro-ai-baby.com of any unauthorised use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account.
6. Acceptable Use
You agree not to use the Service to: (a) violate any law or regulation; (b) infringe the rights of others; (c) generate content involving minors in any sexual context; (d) harass, threaten or impersonate any person; (e) distribute malware or attempt to compromise the Service; (f) reverse engineer, scrape or systematically extract data; (g) resell or sublicense access without our written permission.
7. Prohibited Content
You may not submit, request or attempt to elicit content that depicts minors in sexual situations, non-consensual sexual content, real-person impersonation without consent, instructions for creating weapons, or any content that violates applicable law. We may suspend or terminate accounts that attempt to generate such content.
8. User Content
You retain ownership of any text or data you submit to the Service ("User Content"). You grant Kuro Ai a worldwide, non-exclusive, royalty-free licence to host, store, process and display User Content solely to provide and improve the Service.
9. AI-Generated Output
Output produced by the Service in response to your prompts ("Output") may not be unique to you; similar prompts may produce similar Output for other users. To the extent permitted by law, you may use Output for personal, non-commercial purposes. You are responsible for evaluating Output before relying on it.
10. Intellectual Property
The Service, including the brand, characters, design, code, documentation and other materials, is owned by Kuro Ai and protected by intellectual property laws. Nothing in these Terms transfers ownership to you, except for the limited licence granted to you to use the Service in accordance with these Terms.
11. Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use.
12. Subscriptions and Billing
Some features require a paid subscription. By subscribing, you authorise us or our payment processor to charge the applicable fees and any taxes to your payment method on a recurring basis until you cancel.
13. Free Trials and Promotions
We may offer free trials or promotional pricing. Unless stated otherwise, free trials automatically convert into paid subscriptions at the end of the trial period if not cancelled.
14. Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will continue to have access until that date.
15. Refunds
Except where required by law, all payments are non-refundable. We may, at our sole discretion, offer refunds or credits in exceptional cases.
16. Price Changes
We may change our pricing at any time. Price changes affecting active subscriptions will be communicated in advance and take effect at the next renewal.
17. Taxes
Fees do not include taxes unless explicitly stated. You are responsible for any applicable VAT, sales tax or similar charges arising from your use of the Service.
18. Third-Party Services
The Service may integrate with or link to third-party services. We are not responsible for the content, privacy practices or terms of any third-party services.
19. Privacy
Our Privacy Policy explains how we collect, use and protect your information. By using the Service you consent to our processing of your information as described in the Privacy Policy.
20. Data Retention
We retain conversation history and account data for as long as your account is active or as needed to provide the Service. You may request deletion at any time as described in the Privacy Policy.
21. Suspension and Termination
We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or other users.
22. Effect of Termination
Upon termination your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will survive, including ownership, disclaimers and limitations of liability.
23. Service Availability
The Service is provided on an "as available" basis. We do not guarantee uninterrupted access and may modify, suspend or discontinue any part of the Service at any time, with or without notice.
24. Beta Features
From time to time we may offer beta or experimental features. Such features are provided "as is", may contain bugs and may be modified or removed at any time without notice.
25. Feedback
If you submit feedback, suggestions or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without any obligation to you.
26. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy and non-infringement.
27. Limitation of Liability
To the maximum extent permitted by law, Kuro Ai, its affiliates, officers and employees shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Service.
28. Indemnification
You agree to indemnify and hold harmless Kuro Ai from any claim, demand, loss or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms or your infringement of any third-party right.
29. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country subject to a comprehensive embargo and are not listed on any restricted-party list.

31. Modifications to the Terms

These Terms are governed by the laws of the jurisdiction in which Kuro Ai is established, without regard to its conflict of laws rules. Any dispute shall be resolved by the competent courts of that jurisdiction, unless otherwise required by mandatory consumer protection law.
33. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Kuro Ai regarding the Service.
